Welcome to www.tulucha.org (the “Site”). The Site is operated by Tu Lucha LLC (“Tu Lucha,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the Site and any content, features, or services made available through it (collectively, the “Services”).

By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy and Cookies Statement, which are incorporated here by reference. If you do not agree to these Terms, please do not use the Site.

1. Who We Are

Tu Lucha LLC is a Florida single family office that supports charitable and community initiatives. Charitable programs described on this Site are carried out through Tu Lucha Rising, Inc., a Florida nonprofit corporation recognized by the Internal Revenue Service as a tax-exempt public charity under Section 501(c)(3) of the Internal Revenue Code (EIN #39-5067974). References on the Site to “Tu Lucha Rising” or “our charitable programs” refer to Tu Lucha Rising, Inc.

2. Eligibility

The Site is intended for users who are at least 18 years old, or who are the age of majority in their jurisdiction. If you are under 18, you may use the Site only with the involvement and consent of a parent or legal guardian. By using the Site, you represent that you meet these requirements.

3. Use of the Site

You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates any applicable federal, state, local, or international law or regulation;

  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any part of the Site, its servers, or connected systems;

  • Introduce viruses, malware, or other harmful material;

  • Use any automated means (such as bots or scrapers) to access the Site without our prior written permission;

  • Impersonate or attempt to impersonate Tu Lucha, our staff, or any other person or entity;

  • Use the Site to transmit unsolicited advertising, spam, or any content that is unlawful, defamatory, harassing, or otherwise objectionable.

4. Donations

Donations made through or in connection with the Site support the charitable programs of Tu Lucha Rising, Inc. Donations are processed by third-party payment processors [CONFIRM: e.g., Squarespace Commerce, Stripe, and/or PayPal], and your use of those services is subject to their own terms and privacy policies.

Tu Lucha Rising, Inc. is recognized as a tax-exempt public charity under Section 501(c)(3) of the Internal Revenue Code. Contributions are tax-deductible to the fullest extent permitted by law. No goods or services are provided in exchange for a donation unless expressly stated at the time of the donation. Please retain your donation receipt for tax purposes and consult your own tax advisor regarding deductibility.

Donations are generally non-refundable. If you believe a donation was made in error or an unauthorized charge has occurred, please contact us at [privacy@tulucha.org] and we will work with you in good faith to resolve the matter.

5. Intellectual Property

The Site and its entire contents, features, and functionality (including but not limited to text, graphics, logos, images, video, and the “Tu Lucha” name and marks) are owned by Tu Lucha, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, and other intellectual property laws.

You may view, download, and print content from the Site for your personal, non-commercial use only. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any content from the Site without our prior written consent.

6. User Submissions

If you submit information to us through a contact form, email, or other communication, you represent that the information is accurate and that you have the right to provide it. You grant us a non-exclusive, royalty-free license to use submissions you send us for the purpose of responding to you and operating our programs, subject to our Privacy Policy. Please do not send us confidential or sensitive information you do not wish us to use for these purposes.

The Site may contain links to third-party websites, services, or resources (such as social media platforms, sponsored gyms, or payment processors) that are not owned or controlled by Tu Lucha. We are not responsible for the content, policies, or practices of any third-party sites or services. 8. Disclaimer of Warranties

The Site and Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. To the extent liability cannot be excluded, our total liability arising out of or related to the Site will not exceed one hundred U.S. dollars ($100).

You agree to defend, indemnify, and hold harmless Tu Lucha and its affiliates and their respective directors, officers, employees, volunteers, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Site.

11. Changes to the Site and Terms

We may update, suspend, or discontinue the Site or any part of it at any time without notice. We may also revise these Terms from time to time. The “Effective date” above indicates when these Terms were last revised. Your continued use of the Site after any changes take effect constitutes your acceptance of the revised Terms.

12. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. You agree that any legal action or proceeding relating to the Site will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.

13. Severability and Waiver

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
